A Consumer Financial Protection Bureau (CFPB) official took the witness stand and spoke about the regulatory agency in District of Columbia federal court on Monday, as plaintiffs seek extraordinary relief forcing the Trump administration to maintain the CFPB’s statutory duties. CFPB COO Adam Martinez testified before U.S. District Senior Judge Amy Berman Jackson about the CFPB’s stop-work order. “I don’t want to say, ‘normal,’ but we’re operating,” Martinez said of the CFPB’s current operations, according to The Associated Press.

Deepak Gupta, founding principal of Gupta Wessler, represents a variety of plaintiffs who allege they will suffer irreparable harm if the CFPB is “dismantled” by the Trump administration.

As the CFPB’s acting director and President Donald Trump’s budget chief, Russell Vought issued a general work stoppage in early February. U.S. Department of Justice (DOJ) attorneys for the Trump administration have described Vought’s directive as a temporary “pause” on certain enforcement activities. DOJ attorney Brad P. Rosenberg appeared at Monday’s evidentiary hearing on behalf of his client Vought. DOJ attorneys argue the plaintiffs do not meet the burden justifying a preliminary injunction.

Gupta serves as co-counsel for the National Treasury Employees Union, Virginia Poverty Law Center, National Consumer Law Center, NAACP, and Pastor Eva Steege.

Jackson did not immediately rule on the plaintiffs’ motion for a preliminary injunction but acknowledged she received “hundreds of pages of emails and declarations” from all parties leading up to Monday’s evidentiary hearing.
